Griffith men Daniel Snow and Kurtis Weeks will face trial over their alleged involvement in the 2024 shooting of a man on Carrathool Street. The trial will commence at the Griffith District Court on Monday (15 September).
Both men have pleaded not guilty to the charge of using an offensive weapon while in the company of a person committing an indictable offence.
In March 2024, Brett Sutcliffe, 45, presented to Griffith Base Hospital with an alleged gunshot wound to his leg after emergency services responded to reports that he had allegedly been shot at his home on Carrathool Street.
Griffith police were told that three males allegedly forced entry into the premises, before the man was allegedly shot in the left leg. Mr Sutcliffe’s 15-year-old daughter was in the house with him at the time.
Crown Prosecutor David Patch told a court hearing on Monday (8 September) he would present a new statement in its case against Mr Snow, because the previous statement was inadequate.
“There is material in our [new] brief that raises a claim of consciousness of guilt,” he said.
Consciousness of guilt is a legal doctrine where the post-crime behaviour of an accused is used as evidence of their knowledge of their own guilt.
The defence lawyer, Ms Doosey, said the new Crown statement had changed the landscape of the case and there would be opposition to this evidence, but agreed the matter was ready to proceed to trial.
At an initial hearing on the matter in March 2024, both Mr Snow and Mr Weeks applied for bail but were denied it. Magistrate Trevor Khan noted the two men were already on bail for other offences at the time of the alleged Carrathool Street shooting.
