Riverina woman in court battle to replace her son as administrator of ex-husband’s will

A woman from the small Riverina town of Euberta (near Wagga) has launched Supreme Court action to replace her son as the administrator of her late ex-husband’s will.

Robyn Boreland filed a notice of motion in November 2025 to administer John Leslie Boreland Snr’s will instead of the couple’s son, John Boreland Jnr, who was named as the executor of the deceased estate in the final will of his father.

“There’s an element of urgency to the administration of this estate,” Ms Boreland’s lawyer Justin O’Connor told the court at a hearing on Tuesday (2 December).

“It’s a large estate. There’s two rural properties involved. Someone needs to be appointed to deal with maintaining those properties and paying debt etc for the properties.”

According to a previous judgement published in July 2025, John Jr prevented his 78-year-old mother Robyn from living at her Euberta home after his father’s death, even though John Snr’s final will gave her the home as a life estate, which gives her the right to live there for the rest of her life.

This published judgement also provided the background to the family conflict.

Mr Boreland married Robyn in 1976 and the pair divorced in 1987 but remained on good terms, continuing to live in the same house.

Robyn lived with her ex-husband at the Euberta house until he died in April 2025. She also lived there with her daughter from a previous marriage – Sharron McCartney. The 114-acre property includes a four-bedroom house and a two-bedroom cottage.

After a falling out, John Leslie (Snr) and Robyn had no contact with their son John from December 2017 until December 2024, when the son reignited contact with his father, visiting him in Concord Hospital while he was being treated for gastric cancer.

When John Snr died, his son John Jnr refused to allow his mother to return to the Euberta house, before eventually allowing her to live in the cottage with Sharron.

He also installed CCTV cameras in the property and removed all Robyn’s personal belongings from the house.

Robyn asked the court to grant temporary orders allowing her to live in the main house until the dispute over who should administer the estate was resolved.

The Supreme Court ruled in her favour, ordering John to leave the property and do “all things necessary” to ensure his mother Robyn could move into it.

The July 2025 published decision also stated that John Jnr organised his father’s funeral in Harden, only informing his mother of the time, date and place one hour before the ceremony was due to take place. She was in Wagga when she found out and didn’t have time to get to Harden for it.

Judge Mark Richmond said there was “no sensible explanation” from John Jnr for excluding his mother from the funeral.

“On the evidence presently before the court, [Robyn] has a strongly arguable case that the administration of the estate is in jeopardy and the appointment of [her son John] as executor would not promote the orderly administration of the estate and the welfare and best interests of the beneficiaries,” Judge Richmond stated in his decision.

Robyn and her daughter Lucinda (John Jnr’s sister) have both sought caveats from the court to prevent John Jnr from being granted probate while the estate is being contested.

At the Supreme Court hearing this week, Registrar Lynda Gerritsen gave John Jnr until Friday (5 December) to lodge a written response to his mother’s motion to become administrator of the will.

The matter is listed for a further hearing on Tuesday (9 December) and is expected to be resolved by a probate judge before the end of the year.
